If I File For A Parenting Plan And She Does Not Agree Will The Court Still Give It To Me?

I divorced in 03 she has custody, but my son has lived with me since May of 09′ Now she has hired an attorney to get him back. Will filing a parenting plan stop a big custody fight?

    No it will have to be dealt with in family court. How old is the child? He will have say in where he wants to live. Good Luck

    No, if she contests your proposed parenting plan then it goes into mediation.
    Why did you wait 6 years to file for custody of a child that you have had physical custody of?
    Your best bet is to prove that he has lived with you for the past 6 years and hope a judge will agree that him continuing to live with you is in the child’s best interest. Do NOT do this without an attorney!
